Stockponds.
Before the Whiting Ranch split up its properties and sold them, two stockponds were apparently filled with
irrigation tailwater and possibly directly from Well #3 (55-613297). The stockpond registrations and
adjudication claims for the two ponds all refer to 55-613297 as a source of water. These issues are discussed
in more detail in the 2008 memo.
My understanding is that well could be used to supply Horse Pasture Pond because there is a ditch that connects
the well to the pond, but that the owner of the pond was supposed to agree to pay for water and never did so.
The change in well information forms and adjudication amendments attempt to clarify that the Cavendar wells are not
owned or used by other parties and are used for domestic, irrigation and stockwatering purposes. We might
want to make our amendments stronger or, as Michael and I talked about earlier, possibly draft an agreement with
the neighbor who owns Horse Pasture Pond. If such an agreement is drafted, it needs to clearly state that the
neighbors have no interest or claim to the Cavendar wells and that they will forbear challenging the
Cavendars' water rights claims.
