The Irrigation Wells and Related Statement of Claimant.
There were three irrigation wells, which were claimed in an old State Land Department version statement of
claimant that consisted of three components. As mentioned in the 2008 memo, the statement of claimant
should be amended for a number of reasons, including the correct characterizations of the wells AND to delete
references to the stockponds (see the discussion on the stockponds). A more detailed discussion of the issues is in
the 2008 memo.
Existing Filings.
Corrective Drafts.
Since we last worked on these, ADWR raised its fees to $100 per well registration just for a transfer.
David Brown, the Cattle Growers Association and several others were able to negotiate with ADWR into lowering the
fees. We think the fees will go back down in June to a more reasonable level, but I suggest that we
hold off on filing until the fees go down.
If you want, just mark your changes on the corrective drafts and fax them to me, toll free, at
866-450-4034. The memo discusses the updates and why they were made.
Change in Well Ownership for 55-613295 - The well is
listed as inactive, but if it's going to be used again, the ownership should probably be updated. I suggest that
you hold off on this until the filing fees go down.
Change in Well Information for 55-613296 - The change in well information corrects
the irrigated acreage and removes references to the stockponds (see separate discussion). It adds
stockwatering as a use. There is no filing fee for the change in information.
Change in Well Information for 55-613297 - The changes to this well registration are
similar to the ones for 55-613296. There is no filing fee for the change in well information.
Statement of Claimant No. 39-2140 - There's an in-depth discussion of the issues
associated with this Statement of Claimant in the 2008 memo, as well as my calculations for the claimed volume of
water. The original statement of claimant was filed back when the Arizona State Land Department handled the water
right filings before ADWR was created in 1980. Accordingly, the form included numerous uses. The forms that were
changed per the adjudication separated out various forms for domestic, irrigation, stockpond and other uses (the
latter of which includes stockwatering, fish/rec/wildlife, municipal, etc.) You need to take a close look at the
amendment and schedule.
